Indiana's real property assessment rules were found to be
unconstitutional by the State Supreme Court in December, 1998.  New
rules, being applied in a reassessment in 2002, differ a lot from the old,
unconstitutional rules.  Assessment of real property structures is currently
based on the estimated cost required to replace the structure, less
depreciation based on age, with modifications for condition and quality.  
Under the new rules, improvement assessed values will be the predicted
selling prices of the properties, also known as "market value."  
Assessment of residential, commercial and industrial land also is based
on estimates of sales prices.  Assessment of farm land is based on a
statewide fixed price per acre, called the base rate, modified by the land's
productive capacity, forest cover, grade, and other factors.  Real property
was reassessed for taxes payable in 1996, and is now (in 2002) being
reassessed for taxes payable in 2003.  Assessment of personal property
is done annually by property owners or local assessors, based on
equipment and inventory purchase prices.  Equipment assessments allow
for depreciation.   
INDIANAPOLIS (AP) — A coalition of taxpayer organizations rallied at the Statehouse
on Thursday to urge support for a constitutional amendment to eliminate property
taxes in Indiana.

"Opinion polls and election polling results both confirm that a clear majority of
Hoosiers want to repeal the state's fatally flawed property tax system," said
Indianapolis attorney John R. Price, chairman of the new Indiana Property Tax Repeal
Alliance.

Price said the election last week of Republican challenger Greg Ballard over
Democratic incumbent Bart Peterson for mayor of Indianapolis was based on voters'
unhappiness with property taxes.

"It's sort of the 800-pound gorilla in the room that nobody wants to talk about," Price
said.

He said the coalition, which includes 10 citizens' groups from throughout the state, is
urging repeal of all property taxes, an increase in state income and sales taxes to
make up for the lost revenue and a cap on state spending.

A state legislative commission released a report Tuesday that calls for at least a 50
percent property tax cut for most homeowners and a 25 percent cut for other
residential property such as apartments and second homes. Gov. Mitch Daniels has
proposed another plan to reduce homeowner tax bills by about a third.

Neither of those plans, however, calls for outright repeal of property taxes.

"By doing that (repeal), we think it will open up a lot of economic opportunities because
businesses can come here and instead of a 10-year abatement they get an eternal
abatement," Price said.

He did not say how much the income and sales taxes would have to be raised.

"There's going to be a study that will be released in about two weeks, and that'll set
forth the details of how you replace the money you lose from property taxes with other
tax increases," Price said.
